COMMISSIONS - Terms of Service

By commissioning me, you agree to read and abide by the terms on this page.
Please note that the terms are subject to change.

General Info:

1. I reserve the right to refuse a project that I feel I cannot complete, due to the nature of the work requested, or for any other outstanding reason(s).2. I retain full rights to the composition, commissioned work, and any rejected demos - including the right to upload them to my own sites/portfolio (Twitter, SoundCloud, etc.), commercially or non-commercially for the purpose of showcasing my work. If you are interested in purchasing these full rights, please contact me through discord.3. I require a half payment upfront before beginning work upon a project (USD). This is preferrable through PayPal, Kofi, Venmo or Cashapp.Payment plans are also available on a case-by-case basis.4. All payment is final and non-refundable. If you are in a waitlist/queue and payment has not been exchanged, you may relinquish your slot at any point before work begins.5. I work between a set of projects at a time (generally 1 to 2), with those in queue next in line to be worked upon within said arrangement. Once it is your turn in the queue and work has begun, my average turnaround is anywhere between two weeks - three months depending on the scale of the requested deliverables.Please note that I am less likely to accept your project if you have a deadline. If reasonable, I am willing to work towards the goal of a set date--however, I am simultaneously pursuing a post-secondary education and I currently work between two jobs, so my time available for musical work can be stretched thin at times. All I ask is for your patience and cooperation in return, and I will aim to create a suitable product for you in a timely manner.6. When using the work in any context, you must provide credit back to either my Twitter, YouTube, or Instagram where it is reasonably visible. (example: BGM by @MashablesMusic on Twitter.)7. My availability of communication is between Monday - Friday, from 10:00 AM - 10:00 PM EST. I do tend to work within this timeframe, so an immediate response is not guaranteed, but I will respond at the earliest convienience I am available. Please be sure to keep me up to date with any possible emergencies or updates, concerns, or situations that may appear, and I will be willing to work with you if they come to interfere with our transaction--within reason.Delayed responses on important communications such as project information and WIP feedback may result in the commission being delayed.8. I reserve the right to share (non-NDA) WIPs + completed commissions on social media sites and/or my portfolio.9. Commissions are digital files only, no physical goods will be received. The files will be provided to you via email, Discord, or Twitter, depending on previous methods of communication. Please note that the download link for files will not be guaranteed to be available 7 days post final delivery.10. For any work involving the creation of derivative content (such as covers, re-arranges, remixes, etc.) I am not responsible for any copyright infringement that may occur. Please ensure that you have secured all licensing rights to create and distribute such content.

During the Process:

I tend to begin work through following a process for every song:
Composing + Producing, and Mixing + Mastering.Before I begin work, please provide me with 1-3 references that capture the sound that you'd like to achieve. Additionally, it's very helpful to know what you like about them - even if you don't know the exact instruments used or musical terms!If the work you're seeking is a theme, or piece associated with a certain environment/character, please provide relative details of the reference, in order to help me capture the ideal tone and mood of the song.

Revisions Policy:

These are in the cases of requested changes that need to be made to a song--after the implementation and agreement to include an idea/concept that requires said adjustment.BGM, Character Themes, Original Songs:
One (1) major revision + two (2) minor revisions are included.
Any further desired revisions will be at a rate of $30.00 USD each, and may or may not be possible depending on the ask.Alerts, Jingles, SFX:
One (1) minor revision is included.
Any further desired revisions will be at a rate of $15.00 USD each.
For reference:
- Examples of minor revisions: requesting a small melody, instrument, and volume/effects adjustments.
- Examples of major revisions: requesting entirely new melodies, chord progressions, and the removal/addition of entire sections.Major revisions after the Composing + Producing stage is complete will not be accepted, please make sure that you're happy with the general direction during this period.
Minor revisions are acceptable during the Mixing + Mastering stage.
After the final work is approved and files are delivered, no further revisions will be possible.You may not download or use any work-in-progress or previews in any major format for content before your work is finished. If you want to share WIPs with your community, friends, or small circles, that is fine. Please keep social media sharing of these WIP's to a minimum, though.

Allowed Usage/Copyright Information:

a. By paying for the commission, you are granted an exclusive sync license for the completed work which allows for limited commercial use. With this license, you may:
- Use the work in your monetized streams
- Use the work in monetized videos for sites such as YouTube and Twitter, as long as it is paired alongside original visual content and the audio is not the main focus.b. If you'd like to distribute the work to music services (Spotify, Apple Music, etc.), use it in media (games/film), etc: an additional full commercial use fee and/or royalty split agreement will apply depending on the desired usage.
Full commercial use fees start at 2x the price of the commission.

Non-Allowed Usage:

Uploading the work for the sole purpose of commercial monetization is not allowed, it must be used alongside your own visual content if monetized. Without a full commercial use license, you may not:
- Distribute the work to music stores (Spotify, Apple Music, etc.)
- Upload a monetized video where showcasing the audio work is the main focus (example: song showcase)No one else has permission to use your commissioned work, commercially or non-commercially, unless it is with your direct permission. However, even with your permission, monetization through a third-party is prohibited before contacting me first.You may not use the work without visible credit to me and/or claim the work as your own or someone else's.You may not re-distribute or re-sell the work in any way, including in any blockchain/cryptocurrency-related technology such as NFTs. Please note that the exclusive holder of the license is the person/entity that it was commissioned for, and anyone else who uses it may be subject to copyright infringement and DMCA.If a fraudulent chargeback is filed, your license to use the commissioned work will be revoked and it will be re-sold/re-purposed. You will be forbidden from commissioning me again, and your name/handles will be shared publicly to protect others.

PRICING

Please note that the prices listed on this page are starting prices for personal use commissions for individuals.
Commercial, corporate, & game projects are priced at a higher rate and/or subject to royalty split agreements, depending on the nature of usage.

Stream Alerts + Stinger SFX + Short Intros

Note: Example song is for demonstrating intro style, not song length.

One (1) minor revision is included.

Stream Alerts: Short musical jingles/SFX triggered to play for on-screen alerts.
Stinger SFX: Transistional sounds for changing screens while streaming.
Short Intro: Minimalistic mini-jingles to identify a commissioner or their brand.Please note that my alerts/SFX/intro style is highly musical in nature as opposed to simpler sound effects. I specialize in electronic, symphonic, hip-hop, and 8-Bit styles of sound.If you provide a referenced BGM track that you identify with and hold ownership of, I can key match the SFX/jingles to the song if requested.

Background Music (BGM)

$150
Length: 0:30 ~ 1:00
Base price - subject to increase dependent on desired complexity.
One (1) major revision + two (2) minor revisions are included.

Loopable, unique songs to fit environments, character themes, or backgrounds for variable types of media. I specialize in:
Atmospheric/Downtempo, Fantasy, Piano, lo-fi, EDM, 8-Bit, Hip-Hop+50% of the price per each additional 0:30 ~ 1:00 extension.

Vocals

Vocal features and voiceover work are available on an inquiry-only basis. Currently it is not something I advertise, but I can provide my best available skill in such regards.

Send Off

You will receive full quality WAV + MP3, stereo, 16-bit, 44.1 kHz mastered files.
For pre-masters (only applicable for original tracks):
You will receive full quality WAV, stereo, 16-bit, 44.1 kHz files with a minimum of -5 dB headroom. At request.
